PRIVACY POLICY

The Ikeda Center for Peace, Learning and Dialogue, Inc. (“Ikeda Center”) is a non-profit organization committed to protecting the privacy of visitors to this website (the “Site”).

The purpose of this Privacy Policy is to inform you of what kinds of information we may gather about you when you visit the Site, how we may use that information, whether we disclose it, and the choices you have regarding our use of and your ability to manage and edit the information.  This Privacy Policy applies to the Site and is provided subject to the Terms & Conditions (https://www.ikedacenter.org/terms-conditions). This Privacy Policy does not apply to other websites to which we link.

The Site is operated in the United States.  If you are located outside of the United States, you should be aware that we will collect, process, and maintain your information in the United States.  By using the Site, accessing the Site, or providing any information to the Site, you consent to the transfer of your information to the United States, which may not offer the same level of privacy protection that would be required in your home country, and to the processing and maintaining of that information as described in this Privacy Policy. You understand and expressly consent that data stored in the United States may be subject to lawful requests by the courts or law enforcement authorities in the United States.  If you do not consent to the storage of your Personal Information (see definition under Information Collection below) in the United States, and that your information is subject to the laws of the United States, do not provide us with any of your Personal Information.

We use Shopify to process purchases made through our Site.  When you purchase resources through our Site, Shopify and its payment service providers may receive Personal Information that you provide.  Certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies governing the information they receive for your purchase-related transactions. We do not control Shopify and have no responsibility or liability for Shopify’s collection, use or sharing of your information. We do not receive any credit card or payment information that you provide in connection with your purchases. We will use your Personal Information only as provided in this Privacy Policy.

INFORMATION COLLECTION

We collect personal information when you wish to use certain features of the Site, such as registering to receive information from us, purchasing books, resources or event attendance (“Materials”) from us, submitting questions or comments to us, or providing feedback to us.  When you choose to use these features, we ask for information such as your name, e-mail address, mailing address, phone number, and other personal information related to such purchase (“Personal Information”).

Through the Site, we may automatically gather certain information about the use of the Site, such as how frequently certain areas of the Site are visited, including through the use of cookies, web beacons and other technologies.  See our Cookies section below.

COOKIES

We employ first party cookies that are essential, functional, and analytics.  These include both session and permanent cookies. We use essential and functional cookies to perform essential functions such as remembering your selections of Materials or retaining your preferences relating to the Site.  We use analytics cookies to provide us with important data such as identifying areas of the site visited, how often, and for how long.  As a subscriber to the Shopify platform, our Site enables Shopify to place cookies and collect user information. USE OF PERSONAL INFORMATION

In addition to fulfilling your purchase requests and responding when you contact us, we may use Personal Information for the following general purposes: to fulfill your requests for certain information and services offered through the Site, to send users updates or other general information about Ikeda Center, to meet any applicable legal and regulatory requirements, and to respond to any questions, comments, or feedback you submit.

We may use non-personally identifiable information in the aggregate so that we can improve the Site and the resources that we offer.  We may use or share such aggregated de-identified data with third parties for any purpose.

We do not sell your Personal Information.

PROTECTING PERSONAL INFORMATION

When you give Ikeda Center your Personal Information, we take steps to ensure that your information is treated securely.  Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your Personal Information, Ikeda Center cannot ensure or warrant the security of any information you transmit to us, and you do so at your own risk.  Once we receive your transmission, we use commercially reasonable efforts to ensure its security on our systems, and to protect against the loss, misuse, or alteration of information that we have collected.

DISCLOSURE

Unless otherwise stated in this Privacy Policy, we do not sell, trade or rent your Personal Information to others.  We may permit certain trusted partners to access your information in connection with their performance of services to maintain and operate the Site and certain features on the Site.  We may also share your Personal Information with co-sponsors of Events and resources that we provide.  We do not otherwise disclose any Personal Information or any information about your individual visits to our Site except when we believe in good faith (i) that the law, a court order, or a subpoena requires such disclosure or (ii) that such disclosure is necessary to protect the security of the Site; to enforce or apply our online Terms of Use or other agreements; to prevent or investigate a possible crime, such as fraud or identity theft; or to protect the rights, property, or safety of Ikeda Center or others.

We allow you to opt out of receiving e-mail from us.  If you no longer wish to receive emails from us, you may opt-out of receiving them by emailing us at info@ikedacenter.org.

We use non-personally identifiable information in the aggregate so that we can improve the Site and for business and administrative purposes.  We may use or share with third parties for any purpose aggregated data that contains no personally identifiable information.

Our website may share information with companies that provide support services to us (such as web hosts) or that help us market our products and services (such as email vendors). These companies may need information about you in order to perform their functions on our behalf.  These companies are not authorized to use the information we share with them for any other purpose.

We may decide, for strategic or other reasons, to sell, merge, or otherwise transfer our business or the assets thereof.  A transaction of this type may involve the disclosure of Personal Information to prospective purchasers, successors, or other transferees.  In such cases, we will take reasonable measures to protect the Personal Information we disclose, for example, by requiring the prospective purchaser, successor, or other transferee to sign a non-disclosure agreement limiting the use and protecting the confidentiality of the Personal Information.

Your Personal Information may be transferred to a successor organization if, for example, we transfer the ownership or operation of this Site to another organization or if we merge with another organization or if we sell or otherwise transfer our assets to another organization, whether voluntarily or through insolvency or bankruptcy proceedings.  If such a transfer occurs, the successor organization will acquire our rights to use your Personal Information, but the successor organization’s use of your Personal Information will still be subject to this Privacy Policy and the privacy preferences you have expressed to us.

Except as otherwise stated above, we will not publish or provide your e-mail address or other Personal Information to third parties without your consent.

UPDATING PERSONAL INFORMATION AND PREFERENCES; OPTING OUT

If you have provided us with Personal Information and would like to change, correct, request access to or delete your Personal Information or update or cancel your registration, you may do so by emailing us at info@ikedacenter.org.  In addition, you may opt out of receiving any or all communications from us by emailing us at info@ikedacenter.org or by using the “unsubscribe” link that appears in e-mails received from us.

Some states have adopted laws granting you specific rights to change, correct, request access to or delete your Personal Information.  We will grant your request and comply with your rights as required by law, but you should note that in many situations we must keep your Personal Information to comply with our legal obligations, resolve disputes, enforce our agreements, or for another one of our legitimate business purposes.

We will retain your Personal Information in accordance with applicable law for a reasonable period of time related the reason for which we collected it and in compliance with this Privacy Policy.

You will not be subject to discrimination as a result of exercising your rights described in this Privacy Policy. In some cases, when you exercise one of your rights, we will be unable to comply with the request due to our legal obligations or otherwise, or we will be unable to provide you certain products or services. These responses are not discrimination and our reasons for declining your request or ceasing services will be provided at that time.

You may designate an authorized agent to make a legally allowable request on your behalf. In order to designate an authorized agent to make a request on your behalf, you must mail to us a valid power of attorney, the requester’s valid government issued identification, and the authorized agent’s valid government issued identification.  We have the right to assess the validity of the authorization and to request any reasonable further assurances.

FOR CALIFORNIA RESIDENTS

In addition to the other rights under this Privacy Policy, California’s “Shine the Light” law (Civil Code Section § 1798.83) permits California residents to request disclosure the category of Personal Information we have shared with third parties for the third parties’ direct marketing purposes during the preceding calendar year. To request removal, please contact us at info@ikedacenter.org.  We will respond to your request consistent with applicable law.  Please note that your request does not ensure complete or comprehensive removal of the content or information, as, for example, some of your content may be reposted by another user. 

UK AND EUROPEAN ECONOMIC AREA

This notice applies to you only if are located in the United Kingdom, a member state of the European Union, or the European Economic Area.

We remind you that by providing us with any of your personal data (as defined in the privacy laws of your country of residence) you expressly consent that your personal data be stored in the United States and agree that your personal data may be subject to lawful requests by the courts or law enforcement authorities in the United States.  If you do not consent to the storage of your personal data in the United States, and that your information is subject to the laws of the United States, do not provide us with any of your personal data.

  1. You have the right to obtain from Ikeda Center access to your personal data (as defined in the privacy laws of your country of residence), and the rectification of inaccurate personal data concerning you.
  2. You have the right to obtain from Ikeda Center the erasure or restriction of processing of your personal data in certain circumstances, including when the data is no longer necessary in relation to the purposes for which it was collected or otherwise processed, except when Ikeda Center is required by law to maintain or otherwise process your personal data, for the establishment, exercise, or defense of legal claims, or for the protection of the rights of another person.

If you are within the UK or the European Economic Area, you also have the right to lodge a complaint with the governmental agency responsible for enforcing the data privacy laws in your country, in particular, for individuals located in the European Union, you may contact the supervisory authority in the EU Member State of your habitual residence, place of work, or place of an alleged infringement of the applicable data protection law.  However, we encourage you to contact us first at info@ikedacenter.org and we will try to resolve your concerns.

If you would like to submit a data access, correction, restriction, or deletion request, you can do so by contacting us at info@ikedacenter.org and we will process such request with respect to any Personal Information that we are able to link to you individually based on the information that you can provide to us.  These rights and options that you have with respect to Personal Information are subject to limitations and exceptions under applicable law. 

PRIVACY POLICY CHANGES

We reserve the right to change our Privacy Policy for the Site at any time.  If we decide to change our Privacy Policy, we will post the revised Privacy Policy on the Site and use reasonable efforts to notify you so that you will know what information we gather, how we might use that information and whether we will disclose it to anyone.  Please check periodically to keep informed of any changes. If we materially change this Privacy Policy, the new terms will apply only to (i) Personal Information and other information provided under a prior version of the Privacy Policy by users who affirmatively consent to the new terms and (ii) Personal Information and other information provided after this Privacy Policy has been amended.  In other words, your continued use of this Site after we have posted the revised Privacy Policy constitutes your agreement to be bound by the revised Privacy Policy on a prospective basis, but we will honor the terms that were in effect when we gathered data from you.

CHILDREN

The Site is not directed to children under the age of 13, and we do not solicit or knowingly collect any Personal Information from children under the age of 13.  We encourage families to obtain additional information about safe use of the Internet at http://www.consumer.ftc.gov/topics/kids-online-safety.
